General

Thank you for your interest in the website for the Krueger-Scott Oral History Collection (“Krueger-Scott Website”), hosted by the Center for Migration and the Global City, Rutgers University-Newark, and maintained by Rutgers University Libraries. These terms and conditions of use (“Terms and Conditions”) constitute a legal agreement between you and Rutgers, The State University of New Jersey (“Rutgers”). Please read these Terms and Conditions in their entirety.

The Krueger-Scott Website includes audiovisual works, sound recordings, transcripts, photographs, images, textual works, and other works (“Content”). By using the Krueger-Scott Website or any of its Content, you are agreeing to comply with and be bound by these Terms and Conditions and all applicable laws. If any of these Terms and Conditions are unacceptable to you, please do not use the site.

These Terms and Conditions may change from time to time without advance notice, and we encourage you to review them periodically.  Your continued use of the Krueger-Scott Website indicates your acceptance of any changes to these Terms and Conditions.  Any changes to these Terms and Conditions are inapplicable to disputes arising, or arising out of events occurring, prior to the posting of such changes.

Copyright and Other Rights

Rutgers owns all rights, title, and interest in the Krueger-Scott Website, which is operated by Rutgers University Libraries. The Krueger-Scott Website and its Content are protected by laws including but not limited to copyrights, trademark rights, patent rights, database rights, moral rights, sui generis rights and other intellectual property and proprietary rights.  Your use of the Krueger-Scott Website does not grant to you ownership of any content, code, data, or materials you may access on the website. 

Use of the Krueger-Scott Website and Its Content

The content in this website has been made available for preservation, research, and educational purposes in view-only and stream-only files. No portion or element of the Krueger-Scott Website or its Content may be copied by technical means, downloaded, or extracted, or retransmitted by any means other than the Krueger-Scott Website. Individuals or organizations wishing to reproduce, publish, distribute, display, perform, or otherwise use any part of the Krueger-Scott Website or its Content, other than by quoting excerpts that comply with the fair use limitation in the U.S. or an equivalent copyright exception in another country where the Content is being used, must apply for and obtain written permission from the Center for Migration and the Global City, Rutgers University-Newark. Indemnification

You agree to defend, indemnify, and hold harmless Rutgers and its trustees, officers, agents, and employees from any and all claims, liabilities, costs and expenses, including reasonable legal fees, arising in any way from or relating to your use of the Krueger-Scott Website or its Content, your breach or violation of the law or of these Terms and Conditions, or your unauthorized use of the Krueger-Scott Website or its Content.

Termination

Rutgers may terminate your access to the Krueger-Scott Website and its Content at any time. The permissions granted to you will terminate automatically upon any breach by you of these Terms and Conditions. If we take down or otherwise cease to make a work available as an item of Content, the permission granted to you hereunder to use that Content thereafter will terminate at that time. The Krueger-Scott Website is maintained as a research and educational resource which may be modified or terminated by Rutgers University at its sole discretion.

Applicable Law

These Terms and Conditions, and any claim or dispute that arises from or relates to your use of the Krueger-Scott Website or its Content, shall be governed by the laws of the State of New Jersey without reference to its conflict of laws statutes. Any such claims or disputes shall be heard in the applicable federal or state courts in New Jersey.
